How nicotine pouches have been regulated until now

Because nicotine pouches contain no tobacco and aren't e-cigarettes, they fell outside the UK's tobacco-specific rules (the Tobacco and Related Products Regulations, which implement the EU Tobacco Products Directive). Instead, they've been regulated as an ordinary consumer product under the General Product Safety Regulations 2005 plus standard chemical classification and labeling rules (CLP). In practice, this meant general safety and labeling obligations, but no nicotine-pouch-specific age law, packaging rules, or flavor restrictions — those were left to retailers' own policies.

What's changing: the Tobacco and Vapes Act 2026

The Tobacco and Vapes Act received Royal Assent on April 29, 2026. It's being rolled out in stages, and the first nicotine-pouch-relevant measure takes effect October 29, 2026:

• Age of sale: 18+. From October 29, 2026, it becomes a criminal offense — across England, Wales, Scotland, and Northern Ireland — for any retailer, including online sellers, to sell nicotine pouches (or vapes) to anyone under 18. This is the first time nicotine pouches have had a specific legal age requirement in UK law, rather than relying on individual retailers' voluntary policies.
• Broad regulation-making powers, not yet exercised. The Act separately gives ministers the power to later regulate flavors, packaging/display, and nicotine strength caps for pouches — but as of September 2026, none of those specific rules have been finalized. They are expected to go through public consultation in late 2026 and 2027 before taking effect.

What this means practically, right now

• Nicotine pouches remain fully legal to buy and use in the UK today.
• From October 29, 2026, retailers legally cannot sell to anyone under 18 — a real, enforceable law, not just store policy.
• Flavor bans, mandatory plain packaging, or a nicotine strength cap are possible future changes under the Act's powers, but none are confirmed or in force yet — treat any claim that they already exist as premature.
