Are nicotine pouches legal in the United States?

Yes, but with an important nuance most guides skip: nicotine pouches are regulated by the FDA as "tobacco products" under the Tobacco Control Act, even though they contain no tobacco leaf, because the nicotine in most of them (including synthetic nicotine, since a 2022 law change) falls under the FDA's authority.

What "FDA authorized" actually means

On January 16, 2025, the FDA issued its first-ever Marketing Granted Order for nicotine pouches, covering 20 specific ZYN products at 3mg and 6mg strength, in non-tobacco flavors. In June 2026, the FDA went further and authorized a specific modified-risk claim for those same ZYN products, letting Philip Morris International state that switching from cigarettes to ZYN lowers the risk of several diseases β€” but only for people switching completely, and the order expires and is reviewable after five years.

This authorization does not cover the entire product category. Most other nicotine pouch brands sold in the US have not completed FDA's Premarket Tobacco Product Application (PMTA) review and are, technically, not authorized for legal marketing β€” even though they remain widely available at retail.

Nicotine pouches can only be sold to adults 21 and older nationwide, under the federal Tobacco 21 law.
