Are Nicotine Pouches Legal in China? (Only Under the Tobacco Monopoly)

By PouchGuide Editorial Team · Published October 12, 2026

Nicotine pouches are legal in China only inside the state tobacco monopoly. On January 9, 2026, the State Tobacco Monopoly Administration (STMA) published Announcement No. 1 of 2026. It classifies nicotine pouches as smokeless tobacco products, regulated like cigarettes or cut tobacco. Making or selling them without an STMA license is prohibited, and the rules took effect immediately, with no grace period.

What did China’s 2026 announcement change?

Before 2026, pouches sat in a gray zone in China. Many were made there for export, and some were sold domestically online. Announcement No. 1 ended that:

Can you buy nicotine pouches in China?

Only from licensed channels inside the monopoly system. Unlicensed sellers, including online shops, are now operating illegally. China Tobacco has developed its own pouch brands and showed them to foreign distributors at a trade expo.

A mandatory national standard for pouches went out for consultation from April 7 to May 7, 2026. That suggests licensed domestic products with set specifications are coming.

Can travelers bring nicotine pouches into China?

The announcement is aimed at production and sale, not personal use. Pouches now count as tobacco, so normal customs allowances for tobacco products should apply. Carry only a small personal amount, keep them in original packaging, and declare them if you’re unsure. See our travel guide.

What about Hong Kong, Macau and Taiwan?

They have separate laws. Hong Kong bans the sale of “alternative smoking products” such as vapes and is debating tighter nicotine rules. Taiwan bans unapproved novel nicotine products, and no pouch has been approved.

Bottom line

In China, nicotine pouches are legal only as licensed tobacco products. Since January 2026, anyone making or selling them without an STMA license is breaking the law. For other countries, see our legal status tracker.
