Are Nicotine Pouches Legal in Malaysia? (Only From Pharmacists)

By PouchGuide Editorial Team · Published October 12, 2026

Nicotine pouches aren’t freely legal in Malaysia. In June 2026, the Ministry of Health said pouches contain nicotine, which is a Group C Poison under the Poisons Act 1952. Only authorised persons, such as licensed pharmacists and registered doctors, can supply them. The ministry added that “retail supply is only allowed as a dispensed medicine for specific individuals.” Selling pouches online without authorisation “may constitute an offence.”

Why are pouches a “poison” in Malaysia?

Malaysia’s Poisons Act 1952 lists nicotine as a controlled poison. Cigarettes and vapes are covered by a separate law, the Control of Smoking Products for Public Health Act 2024 (Act 852). Tobacco-free pouches don’t fit cleanly into Act 852. So the ministry treats them under the Poisons Act, the same law that controls nicotine medicines.

Can you buy nicotine pouches in shops or online?

Not legally from ordinary sellers. The ministry said:

Enforcement is happening. The ministry mentioned a raid in Selangor in January 2026 that seized 39 pouch-linked products.

Is the law changing?

Possibly. In May 2026 the High Court ruled that the government’s 2023 removal of liquid nicotine from the Poisons List was unlawful, and the government withdrew its appeal. Lawmakers and advocates are now asking the government to clarify how the Poisons Act and Act 852 fit together. Until that happens, the ministry’s June 2026 position is the best guide.

Can travelers bring nicotine pouches into Malaysia?

There’s no clear official rule for personal-use pouches. Since the ministry treats nicotine as a controlled poison, bringing pouches in is a risk. Pack only a small personal amount if you bring any, and be ready to declare it. See our guide to traveling with nicotine pouches.

How Malaysia compares

Malaysia sits between Thailand, where pouches are sold as tobacco, and Singapore, where they’re prohibited. Its pharmacy-only model looks a lot like Canada’s.

Bottom line

In Malaysia, nicotine pouches count as a controlled poison. Only pharmacists and doctors can supply them, and online sales by anyone else may be an offence. The legal picture could change as the government reconciles its nicotine laws. See our legal status tracker for other countries.
