Are Nicotine Pouches Legal in Australia? The July 2026 Rules

By PouchGuide Editorial Team · Published September 25, 2026

No. Since 24 July 2026, there has been no lawful way for consumers to buy or import nicotine pouches in Australia. Not in a shop, not online, not by personal import, and not with a prescription.

Australia hasn’t banned pouches with one sweeping law, the way France did. Instead it closed every remaining legal pathway one by one. Here’s how that works.

How Australia regulates nicotine pouches

In Australia, nicotine for human use is treated as a medicine. Nicotine pouches are regulated by the Therapeutic Goods Administration (TGA) as unapproved therapeutic goods. No nicotine pouch has been approved by the TGA, so retailers, including online sellers, have never been allowed to sell them.

Before July 2026, a few narrow routes still existed. A person could import pouches for their own use under the Personal Importation Scheme, a doctor could prescribe them through special schemes, or a pharmacist could compound them. The new regulations closed all of these.

What changed on 24 July 2026

According to the TGA’s announcement of 17 July 2026, from 24 July 2026 people can no longer:

Put simply, a prescription no longer helps. The TGA says there is limited evidence that pouches help people quit smoking or manage nicotine dependence. It also cites concerns about high or inconsistent nicotine content, possible contaminants, misleading labels, and appeal to young people.

Enforcement

The TGA and Australian Border Force enforce these rules. Pouches that arrive at the border can be seized. The TGA regularly publishes enforcement actions. In one March 2025 operation, it seized more than 7,000 nicotine pouches from two locations in Western Sydney. In January 2026 it issued infringement notices totalling $43,560 to six people over alleged unlawful importation and advertising of therapeutic goods.

The TGA also asks the public to report anyone unlawfully selling or supplying pouches.

If you’re traveling to Australia

Because personal importation is no longer allowed, don’t plan on bringing your own pouches. Check the Australian Border Force’s current rules before you fly, and expect pouches found at the border to be treated as prohibited imports. For more on flying with pouches, see our travel guide.

The TGA points people who want to quit smoking or manage nicotine dependence to approved options:

If you currently use pouches and want to stop, our guide to quitting nicotine pouches covers tapering, withdrawal and where to get help.

How Australia compares

Australia and France now have the two toughest regimes. France bans possession and use outright (see our France guide). Australia shuts off every legal source of supply. Canada allows one authorized brand from behind the pharmacy counter (see our Canada guide). For more countries, see countries where nicotine pouches are banned.

Bottom line

Nicotine pouches are effectively banned in Australia. Since 24 July 2026 there is no legal route for consumers to get them: retail sale was never allowed, and personal importation, prescriptions and pharmacy compounding are now closed too. Don’t bring pouches into the country. If you need help with nicotine dependence, approved NRT and Quitline (13 7848) are the legal options.
