Are Nicotine Pouches Legal in Brazil? (No, None Are Authorized by Anvisa)

By PouchGuide Editorial Team · Published October 12, 2026

No, nicotine pouches can’t legally be sold in Brazil. Brazil has no specific law on them, but the health regulator Anvisa treats them as smoking products (produtos fumígenos), the same group as cigarettes and cigars. A smoking product may only be sold once its registration is granted and published in the official gazette, and Anvisa says that “currently, there is no product registered or authorized”. Pouches sold online or in shops in Brazil are therefore illegal. In 2026 Anvisa began a regulatory process that could lead to rules for nicotine pouches, but it stresses that this does not mean they are allowed.

This is general information, not legal advice. Check official sources before you buy or travel.

Why are nicotine pouches not allowed in Brazil?

In Brazil, any product made to be smoked, sniffed, chewed or sucked that contains nicotine or tobacco is a produto fumígeno and needs Anvisa registration before it can be made, imported or sold. Nicotine pouches have never been registered. They are also not e-cigarettes, which Brazil bans separately under RDC 855/2024.

What is Anvisa doing about nicotine pouches?

Nicotine pouches are on Anvisa’s 2026–2027 Regulatory Agenda as item 16.5, “regulation of emerging smoking products, such as nicotine pouches”. On May 25, 2026, Anvisa opened a targeted consultation (Consulta Dirigida 6/2026) to collect information on “pouches, sachets and strips containing nicotine” from health authorities, academics, industry and others, with a deadline of June 29, 2026. The information will feed into a regulatory impact analysis. After that, Anvisa could either create rules that allow pouches or keep them off the market.

Are nicotine pouches sold in Brazil anyway?

Yes, illegally. Investigative reporting found pouches from major brands being smuggled into Brazil and promoted to young people on Instagram as an “alternative” to vapes. Products sold this way are not registered and may be seized.

Can travelers bring nicotine pouches to Brazil?

There is no clear allowance. Pouches aren’t registered in Brazil, and customs can seize unregistered nicotine products. If you bring any, keep it to a small amount for personal use and don’t try to sell or give them away. See our travel guide.

How Brazil compares

Brazil is moving more slowly than its neighbor Argentina, which created a registration system for pouches in May 2026. It is similar to Chile, where no pouch has been authorized either. Colombia, in contrast, allows pouches under its tobacco control law.

Bottom line

Nicotine pouches are not legal to sell in Brazil: Anvisa counts them as smoking products that need registration, and none has been registered. A regulatory process started in 2026, but until Anvisa issues new rules, every pouch on the Brazilian market is illegal. See our legal status overview for other countries.
