Are Nicotine Pouches Legal in Luxembourg? (Effectively No, Since 2026)
Effectively no: normal nicotine pouches can’t be sold in Luxembourg. The law of November 28, 2025, in force since January 1, 2026, bans placing on the market, selling, distributing or giving away nicotine pouches with more than 0.048 mg of nicotine per pouch. Ordinary pouches contain roughly 2 to 20 mg, so the cap rules out every normal product. Luxembourg also bans online and other distance sales, advertising, and sales to under-18s.

What does Luxembourg’s 2025 law say about nicotine pouches?
Bill No. 8333 amended Luxembourg’s anti-tobacco law of August 11, 2006. Parliament adopted it on October 30, 2025, and it took effect on January 1, 2026. The law defines a “nicotine pouch” as a tobacco-free oral product made wholly or partly of synthetic or natural nicotine, and brings pouches under the same rules as tobacco. The new Article 7(4) bans placing on the market, selling, distributing or offering for free any nicotine pouch containing:
- more than 0.048 mg of nicotine per pouch;
- additives that make nicotine easier to absorb;
- caffeine, taurine, CBD or other additives and stimulants linked to energy or relaxation.
Pouches must also be child-resistant and tamper-evident, and makers must follow EU food-hygiene rules. The same 0.048 mg cap applies to other “new nicotine products,” per unit or per gram.
Is it a ban or just a nicotine limit?
On paper it’s a nicotine limit. In practice it works as a ban. Even a “light” 2 mg pouch has about 40 times more nicotine than the cap allows, so no mainstream brand can legally be sold. Luxembourg’s Chamber of Commerce called the bill a “disguised ban” (interdiction déguisée) on selling pouches during the debate. The government chose this route instead of the full ban some health groups asked for.
What other rules apply?
- Age 18: selling or giving pouches to anyone under 18 is banned, and sellers must ask for ID if they’re unsure of a buyer’s age.
- No distance sales: the ban on online and other distance sales of tobacco now covers nicotine pouches.
- No advertising or sponsorship, the same as for tobacco.
- No use in places for young people: using pouches is banned in schools, in premises that host children under 16, and in playgrounds and sports grounds used by under-16s.
- Notification: makers and importers must report ingredients and sales volumes to the health directorate.
- Enforcement: customs officers (ADA) and health-directorate doctors can investigate breaches.
A draft grand-ducal regulation, sent to the Council of State in 2026, would also require round cans and bilingual French and German warnings covering 50% of the side and 65% of the lid. That regulation was still a draft at the time of writing.
Can you use or bring nicotine pouches in Luxembourg?
The law targets supply: placing on the market, selling, distributing and giving away. It doesn’t ban adults from possessing pouches, and it bans use only in the places listed above. That doesn’t make it safe to bring large amounts, and you can’t legally buy normal pouches once you’re there. Bring only a small amount for personal use, and see our travel guide.
How Luxembourg compares
Luxembourg reached a near-ban by a different route than its neighbors. Belgium banned pouch sales outright in 2023, and France bans even possession and use. Germany doesn’t allow pouches to be sold as food. Luxembourg’s cap is close to the Netherlands’ earlier 0.035 mg limit; the Netherlands has since banned sales completely.
Bottom line
Luxembourg doesn’t formally ban nicotine pouches, but since January 1, 2026 its 0.048 mg per pouch cap, online sales ban and advertising ban mean normal pouches can’t be legally sold there. See our list of countries where pouches are banned and our legal status overview.
