Are Nicotine Pouches Legal in Poland? (Yes, 18+, No Online Sales)

By PouchGuide Editorial Team · Published October 12, 2026

Yes, nicotine pouches are legal in Poland for adults. An amendment to Poland’s tobacco law, published as Dziennik Ustaw 2025, item 799, took effect on July 5, 2025. It brings “nicotine pouches” (woreczki nikotynowe) under the same rules as tobacco. That means no sales to anyone under 18, a ban on online and other distance sales, including cross-border, a 20 mg/g nicotine cap, and a health warning on every can.

This is general information, not legal advice. Check official sources before you buy or travel.

What does Poland’s 2025 law say about nicotine pouches?

The Act of 21 May 2025 adds a legal definition: a nicotine pouch is any product for oral use (other than one meant to be inhaled) that contains nicotine but no tobacco and comes portioned into pouches. The main rules:

The law took effect 14 days after publication on June 20, 2025. Pouches sold as medicines are excluded.

Are flavored nicotine pouches banned in Poland?

Not yet. The government has proposed a bill that would ban flavorings in nicotine pouches, alongside a ban on disposable e-cigarettes. As of October 2026 it hadn’t taken effect, so flavored pouches are still legal in Polish shops.

Can I order nicotine pouches online in Poland?

No. Since July 2025, distance selling of pouches to consumers in Poland is banned, whether the shop is Polish or foreign. You can still buy pouches in person at kiosks, gas stations and tobacco shops if you’re 18 or older.

Can travelers bring nicotine pouches to Poland?

The 2025 law covers selling, not carrying. Bringing a personal supply for your own use is fine. If you’re arriving from outside the EU, normal customs rules for tobacco-type products apply. See our travel guide.

How Poland compares

Poland regulates pouches rather than banning them, like Denmark and Finland. Its 20 mg/g cap is looser than Denmark’s 9 mg per pouch. It’s very different from the Netherlands and Belgium, which ban sales outright.

Bottom line

Nicotine pouches are legal in Poland for adults 18 and over. Since July 2025 they can only be sold in person, with a 20 mg/g nicotine cap and mandatory health warnings. A flavor ban has been proposed but isn’t law yet. See our legal status tracker for other countries.
