Is Snus Legal in Germany? (And Why Nicotine Pouches Are)

By PouchGuide Editorial Team · Published September 15, 2026

No — traditional snus (tobacco-leaf-based oral tobacco) cannot legally be sold in Germany. But like the UK, Germany still sells tobacco-free nicotine pouches openly, and the reason is the same kind of legal distinction: the ban targets tobacco specifically, not nicotine pouches.

The actual law

Under § 11 of the Tabakerzeugnisgesetz (Tobacco Products Act), it is prohibited to place tobacco products for oral use on the market in Germany. This isn’t a Germany-specific quirk — it directly implements Article 17 of EU Directive 2014/40/EU, which requires all EU member states to prohibit placing oral tobacco on the market, with a historical exception carved out only for Sweden. Germany, like every other EU country besides Sweden, has no such exception.

Possession is different from sale

As with the UK, the German rule targets placing the product on the market — manufacturing, distributing, and selling it — not personal possession or use. Bringing snus into Germany for personal consumption isn’t itself a punishable offense; selling it commercially is what the law prohibits.

Why nicotine pouches aren’t covered

The EU directive’s ban specifically targets “tobacco for oral use.” Nicotine pouches contain nicotine (tobacco-derived or synthetic) plus a plant-fiber filler, flavoring, and pH adjusters — no tobacco leaf. That’s the same distinction that keeps nicotine pouches legal in the UK: no tobacco leaf means the product falls outside the scope of a law written specifically about tobacco. This is why brands like ZYN, VELO, and Nordic Spirit are sold at retail across Germany while a tin of traditional Swedish snus is not.

How this compares to the UK

Germany and the UK arrive at the same practical outcome — snus banned for sale, nicotine pouches legal — through slightly different legal paths. The UK’s ban traces to the same EU directive but was retained as domestic law after Brexit; Germany’s ban is the direct, current implementation of that EU directive as an EU member state. See our UK snus legality explainer for that comparison in more detail.

What this means practically

If you’re in Germany and trying to choose between snus and nicotine pouches based on what’s actually available to buy, nicotine pouches are your legal retail option — traditional snus, regardless of brand, is not sold legally there. See our nicotine pouches vs. snus comparison for how the two products differ beyond the legal question.

Bottom line

Snus is banned for sale in Germany under § 11 of the Tabakerzeugnisgesetz, implementing an EU-wide directive that exempts only Sweden. Nicotine pouches are legal because they don’t contain the tobacco leaf that law targets — the same core distinction that applies across the EU and UK.
