UK Nicotine Pouch Rules From 29 October 2026: What the Tobacco and Vapes Act Changes

By PouchGuide Editorial Team · Published September 25, 2026

Until now, nicotine pouches sat in a gap in UK law. Because they contain no tobacco, they weren’t covered by the tobacco age-of-sale rules, and there was no legal minimum age to buy them. News reports of free pouches being handed out to young people made that gap hard to ignore.

The Tobacco and Vapes Act 2026 closes it. The Act received Royal Assent on 29 April 2026, and the first measures affecting nicotine pouches take effect on 29 October 2026. Here’s what changes, based on the UK government’s official guidance.

What changes on 29 October 2026

According to GOV.UK’s guidance for retailers, published in August 2026:

The rules apply across England, Wales, Scotland and Northern Ireland.

Penalties

Trading Standards and equivalent bodies can issue fixed penalty notices for these offences instead of going straight to court:

More serious or repeated cases can still be prosecuted. The government’s fixed penalty guidance has the details for each offence.

What comes later

The October 2026 changes are the first stage. When the Act became law, the government described further measures, including:

These depend on further regulations, so dates will follow. The Act’s best-known measure, the “smokefree generation” rule making it illegal to sell tobacco to anyone born on or after 1 January 2009, applies to tobacco, not to nicotine pouches.

What it means if you buy pouches

What it means for shops

If you sell nicotine pouches, the government guidance is the place to start. In short: from 29 October 2026, treat nicotine pouches like vapes and tobacco. Train staff on age checks, keep a refusals log, and stop any promotional giveaways. Online sellers need proper age verification too.

How the UK compares

The UK is moving from no rules to standard age-of-sale and marketing controls. It is not banning pouches. That puts it well short of France, which bans possession and use outright (see our France guide), and Australia, which has closed every consumer route (see our Australia guide). For current UK use levels, around 1% of adults, see how popular pouches are by country. Our UK legal overview covers the wider picture.

Bottom line

From 29 October 2026, the UK sets a legal minimum age of 18 for nicotine pouches for the first time. Selling to under-18s, buying for them, and promotional giveaways all become offences, with £200 fixed penalties in England, Wales and Scotland and £250 in Northern Ireland. Advertising, packaging and licensing rules are due to follow under the same Act. Adults can still buy pouches legally, but expect more ID checks and no more free samples.
