Are Nicotine Pouches Legal in Italy? (Yes, Max 16.6 mg, No Online Sales)
Yes, nicotine pouches are legal in Italy for adults 18 and over. Italy’s 2026 Budget Law (Law 199/2025) added pouch-specific rules. Pouches can contain at most 16.6 mg of nicotine each, must come in child-resistant, tamper-evident packaging with health warnings, and can’t be sold at a distance, including by online shops in other countries. Sales to minors were already banned.

What are Italy’s nicotine pouch rules?
According to the Italian Society of Pharmacology (SIF) and consumer group Altroconsumo, the 2026 Budget Law sets these rules:
- 16.6 mg cap: no more than 16.6 mg of nicotine per pouch.
- Packaging: packs must be child-resistant and tamper-evident, with information and health warnings.
- No distance sales: online and other remote sales are banned, including cross-border sales to Italian consumers.
- Age 18: selling to minors is banned. Retailers already had to check age under Legislative Decree 6/2016.
- Penalties: ItaliaOggi reports fines of up to €150,000 for manufacturers and €5,000 for retailers.
Pouches have had their own tax category since 2022. They’re sold mainly through tabaccherie (licensed tobacconists) overseen by the customs and monopolies agency (ADM).
Why did Italy act on nicotine pouches?
An Altroconsumo investigation found 31 unauthorized pouch products for sale online, many with more nicotine than allowed. Health groups also pointed to rising use among young people. The Budget Law answered with a strength cap and an end to online sales, rather than a ban.
Can I order nicotine pouches online in Italy?
No. Distance selling to consumers in Italy is now banned, whether the seller is Italian or foreign. Buy pouches in person at a tabaccheria or another authorized outlet.
Can tourists bring nicotine pouches to Italy?
Yes. The rules cover selling, not carrying. You can bring your own supply, including pouches stronger than 16.6 mg, for personal use. You just can’t buy those locally. See our travel guide.
How Italy compares
Italy sits in the “regulate, don’t ban” group with Poland, Denmark and Spain. Its 16.6 mg cap is stricter than Poland’s 20 mg/g but looser than Denmark’s 9 mg. Neighboring France bans pouches entirely, and Switzerland sells them to adults.
Bottom line
Nicotine pouches are legal in Italy for adults 18 and over. Since the 2026 Budget Law they’re capped at 16.6 mg per pouch, need child-resistant packs, and can’t be sold online. See our legal status tracker for other countries.
