Are Nicotine Pouches Legal in the Czech Republic? (Yes, 18+, Max 12 mg)

By PouchGuide Editorial Team · Published October 12, 2026

Yes, nicotine pouches are legal in the Czech Republic for adults 18 and over. Czechia was one of the first EU countries to write rules specifically for them. A 2023 amendment to the addictive substances law banned sales to under-18s, and Decree No. 141/2023, in force since July 1, 2023, caps pouches at 12 mg of nicotine each and 240 mg per can, bans caffeine, taurine and vitamins, and requires a health warning covering 30% of the can.

What are the rules for nicotine pouches in Czechia?

Czech law treats tobacco-free nicotine pouches as their own product category. The main rules come from two sources.

The 2023 amendment to Act No. 65/2017 on protecting health from addictive substances, signed by the president in February 2023:

Decree No. 141/2023 Coll. from the Ministry of Health, in force since July 1, 2023:

Products that didn’t meet the decree could be sold for 12 months after it took effect, so since mid-2024 every pouch on the Czech market should comply.

Why did Czechia regulate nicotine pouches?

Lawmakers pointed to around two dozen cases of children overdosing on pouches, some losing consciousness, and to surveys showing that many young teens had tried them. The Health Ministry had warned that pouches “could, and still can,” contain unlimited nicotine before the cap.

Can you buy strong nicotine pouches in Czechia?

Not legally. Anything above 12 mg per pouch can’t be sold in Czech shops or by Czech online sellers, so “extra strong” products sold elsewhere in Europe are not legally available.

Can travelers bring nicotine pouches to Czechia?

Yes. Possession is legal, and there is no specific limit on pouches for personal use. The 12 mg cap applies to products sold in Czechia, not to what you carry. See our travel guide.

How Czechia compares

Czechia’s 12 mg cap is stricter than Italy’s 16.6 mg but far looser than Denmark’s 9 mg. Unlike Poland, Czechia still allows online sales, as long as the seller verifies age. Neighboring Austria now sells pouches through tobacconists only, and Germany remains a gray area.

Bottom line

Nicotine pouches are legal in the Czech Republic for adults 18+. Since 2023 they are capped at 12 mg per pouch, must carry a 30% health warning, and can’t contain caffeine or vitamins. See our legal status overview for other countries.
